This is a task for a lawyer based/expert of UK law. I am a EU citizen. 10 years ago I moved to UK and after some employment years I decided to open my own firm. I established my construction company, but for some reason the banks didnt want to open an account for my company (too few years of residence in the UK?!). My accountant proposed then to solve the problem temporarily by appointing him as the director/main person. He was a friend and recommended person, i trusted and proceeded that way. Time has passe, I work with my small company earning a good reputation with clients, with relatively small turnover - 200k / year. My accountant had a stroke a last year, and after that event I thought that it would be time that I get control over my company. But when I asked the guy, he said that this is his company and has no intention to give it to me. I am the only guy working and bringing revenues, and he is the accountant/director who basically keeps control over the money, bank account etc... I have a company bank card with which I buy supplies and withdraw cash. I am good in construction, but apparently not good in finance or business, and trusted the wrong people. Anyways, I am ready to pay for getting my firm back, if there is a possibility.

As a former attorney I have experience with cases like this. What I would do is first study ALL relevant documents that you may have, including copies of bank statement from which it appears that you were the actual owner of the bank account, as well as the correspondence after the passing of the accountant. Then I would draft a very powerful letter claiming your entitlement to the bank account and ordering them to legally change the ownership as such. In the letter I would also state that you will start summary proceedings if this will not be changes. I would take over correspondence with them on your behalf. Only if they will keep refusing to do so, I would recommend you to actually start proceedings. I can help you do this, but for that, you would need an actual licensed attorney in the UK.
