My husband an I own a US trademark. After five years we now have to file a “Declaration of Use and/or Excusable Nonuse of a Mark under Section 8”. We are both German citizens and used German addresses when we applied for the trademark in 2015. We just learned that since 2019 foreign-domiciled owners now need a US licensed attorney to represent us before the USPTO in any application or registration related filing.

Although we now have a US domicil address, we are not even allowed to change our address ourselves. Apparently, this requires a US attorney as well. The USPTO Trademark Electronic Application System puts me in a stupid loop here.

I am now looking for a US based and licensed Patent and Trademark Attorney who can represent us and change the address of the trademark owners for us.

I would then be happy to file the “Declaration of Use” myself since I have nearly completed the entire filing process already until the USPTO online system stopped me.

However, if you have a good package price for changing our address and filing the “Declaration of Use and/or Excusable Nonuse of a Mark under Section 8” I am happy to look into that option.
